   Title Examinations
  • The examination of title is a process which requires care, perseverance, completeness and attention to detail. 
  • There are four steps in the title examination process:
    • Identification of Property - usually by using a deed copy, deed reference, plan reference, map or survey.
    • Establish chain of title - The chain of title ownership for the property being examined needs to be established for a period of at least 60 years.  The chain of title is comprised of the succession of transfer events by which title to the property being examined has been conveyed through the years.
    • Search chain of title - Once the chain of title has been established, you need to search the records of the county for each owner during their period of ownership.
    • Review and report - An abstract of title, from which an attorney may give an opinion as to the condition of title, is compiled.

   Title Insurance

Title insurance insures against loss resulting from defects of title to a specifically described parcel of real property.  Defects may run to the fee (chain of title) or to encumbrances.
There are two principal forms of title insurance:  lender’s policy and the homeowner’s policy.
